Terms of Service

These terms are a contract between you and rootcharts, operated by Kevin Krall (“rootcharts”, “we”, “us”), covering your use of rootcharts.com and the rootcharts web application (the “Service”). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

1. The Service

rootcharts is browser-based charting and order-flow analytics software for futures markets, with optional order routing to a brokerage account you hold with a supported broker. We provide software and data visualisation only. We are not a broker, investment adviser, or commodity trading adviser, and nothing in the Service is investment advice, a recommendation, or a solicitation to buy or sell any instrument.

2. Eligibility and account

You must be at least 18 years old and able to enter into a binding contract. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@rootcharts.com if you suspect unauthorised use. One account per person; accounts may not be shared.

3. Subscriptions, free trial and payment

• Plans. Access to the Service requires a paid subscription, billed monthly or yearly in advance at the prices shown on the pricing page at the time of purchase. Prices exclude any applicable taxes.
• Free trial. New customers receive a 7-day free trial. A payment method is collected at sign-up and the first charge is made automatically when the trial ends, unless you cancel before then. The trial is limited to one per person and one per payment card; we may end or refuse a trial where we detect repeat use.
• Renewal. Subscriptions renew automatically at the end of each billing period until cancelled.
• Cancellation. You can cancel at any time from your account. Cancellation takes effect at the end of the current period; you keep access until then. Cancelling during the trial means you are never charged.
• Refunds. Payments for periods already started are non-refundable, except where required by law. If you are a consumer in the EU/EEA or UK you agree that access to the Service begins immediately and acknowledge that your statutory right of withdrawal ends once the Service has been fully performed within the withdrawal period.
• Price changes. We may change prices with at least 30 days’ notice by email. Changes apply from your next renewal; you may cancel before then.
• Payment processing is handled by Stripe under its own terms. Failed payments may lead to suspension of access until settled.

4. Market data

Market data displayed in the Service is sourced from CME Group exchanges via licensed data vendors and is provided for your personal, non-professional use within the Service. You may not redistribute, resell, scrape, or systematically extract the data or derived values. The exchanges and vendors are third-party beneficiaries of this section. If you are a professional subscriber under exchange rules, you must tell us before use; different fees may apply.

5. Broker connection and trading

Connecting a brokerage account (currently Tradovate) is optional and done through the broker’s own authorisation flow; your relationship with the broker is governed by its agreements. When you place, modify or cancel orders through rootcharts, you are instructing your broker; we transmit those instructions but do not execute, clear or hold funds. You are solely responsible for every order sent from your account, including orders resulting from mistaken clicks, misconfigured settings, network delays or software errors. Always verify positions and working orders in your broker’s own platform.

6. Risk disclosure

Futures trading involves substantial risk of loss and is not suitable for every investor. You can lose more than your initial deposit. Past performance, including any examples, screenshots or recaps published by us, is not indicative of future results. Order-flow tools show what has happened in the market; they do not predict what will happen. Any trading decision is yours alone.

7. Acceptable use

You agree not to: share your account or circumvent access controls; reverse-engineer, copy or create derivative works of the Service; use bots, scrapers or automated means to access the Service or its data; interfere with its operation or security; use it for any unlawful purpose or in breach of exchange or broker rules; or remove any proprietary notice. We may suspend or terminate accounts that breach these terms.

8. Intellectual property

The Service, including its software, design, indicators, and content, is owned by rootcharts or its licensors and protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own trading during your subscription. Your chart layouts, drawings and notes remain yours; you grant us a licence to store and display them to you as part of the Service.

9. Availability and changes

We aim for the Service to be available whenever the markets are open, but it is provided “as is” and “as available”. Data feeds, brokers, hosting providers and the internet can fail, and we may take the Service offline for maintenance. We may add, change or remove features at any time. The Service is in active development and features labelled beta may change or be withdrawn without notice.

10. Disclaimer of warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including accuracy, completeness or timeliness of market data, fitness for a particular purpose, and uninterrupted or error-free operation.

11. Limitation of liability

To the fullest extent permitted by law, rootcharts will not be liable for any trading losses, lost profits, or indirect, incidental, special or consequential damages arising from your use of or inability to use the Service, including losses caused by data delays or inaccuracies, order-routing errors, or downtime. Our total liability for all claims in any twelve-month period is limited to the amount you paid us for the Service in that period. Nothing in these terms limits liability for intent, gross negligence, injury to life, body or health, or any liability that cannot be limited by law.

12. Termination

You may stop using the Service and delete your account at any time by contacting us. We may suspend or terminate your access if you materially breach these terms, if required by law, or if a data vendor or broker withdraws the rights needed to serve you; in the latter case we refund any prepaid, unused portion of your subscription.

13. Changes to these terms

We may update these terms. The date at the top shows the latest revision. For material changes we will notify you by email or in the app at least 14 days before they take effect; continued use after that date means you accept them.

14. Governing law

These terms are governed by the laws of the Federal Republic of Germany, without prejudice to mandatory consumer-protection rules of the country where you live. The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr; we are not obliged and do not undertake to participate in dispute-resolution proceedings before a consumer arbitration board.
